Purchase Agreement and IndemnificationAgreement

This Purchase Agreement ("Agreement") outlines the terms and conditions for the use of products purchased from CrackledFlame Candle Company ("CrackledFlame"). By making a purchase, you ("Purchaser") agree to adhere to the following terms:

  1. Safe Usage and Compliance:

    • Purchaser agrees to use all purchased products safely, strictly following all provided directions, warnings, specifications, and manufacturer guidelines as specified by CrackledFlame Candle Company.

  2. Legal Compliance:

    • CrackledFlame Candle Company sells its merchandise exclusively to individuals who can legally purchase and own such items in their respective jurisdictions. By placing an order and purchasing merchandise from CrackledFlame Candle Company, Purchaser represents and warrants that they are of legal age to purchase the merchandise and that it can be lawfully owned in their state, county, and/or city of residence.

  3. Indemnification Agreement:

    • By purchasing and using products sold by CrackledFlame Candle Company, Purchaser agrees to indemnify and hold CrackledFlame Candle Company, its officers, agents, and employees, free and harmless from any liability for incidental or consequential damages, including third-party claims for damages against property. This indemnification extends to any liability arising from the application or use of any product purchased from CrackledFlame Candle Company.

  4. Limitation of Liability:

    • CrackledFlame Candle Company shall not be held responsible for any damage that may occur due to the misuse of its products or any damages related directly or indirectly to candle burning. Purchaser acknowledges and accepts this limitation of liability.

Miscellaneous:

  • This Agreement constitutes the entire understanding between the Purchaser and CrackledFlame Candle Company concerning the subject matter herein and supersedes all prior agreements, whether written or oral.

  • Any amendments or modifications to this Agreement must be in writing and signed by both parties.

  • This Agreement shall be governed by and construed in accordance with the laws of Texas, without regard to its conflicts of law principles.

By completing the purchase, you acknowledge that you have read, understood, and agreed to the terms and conditions outlined in this Purchase Agreement and Indemnification Agreement.

CrackledFlame Candle Company reserves the right to update or modify this Agreement as needed, and such changes will be effective upon posting on the CrackledFlame Candle Company website.
